End User License Agreement
This License for LEGO Universe (hereinafter the "Game") is granted by LEGO System A/S, Aastvej 1, DK-7190 Billund, Denmark (hereinafter "LEGO").
IMPORTANT -- READ CAREFULLY: This is a legal agreement between you and LEGO. It imposes certain restrictions on your use of the Game. LEGO and its affiliates and licensors retain ownership of the Game, and no rights are granted to you other than a license to use the Game as well as any printed materials and any on-line or electronic Manual (the "Manual") on the terms expressly set forth in this Agreement. By clicking on the "I accept the License Agreement(s)" button below you agree to be and are hereby bound by the terms of this License Agreement. If you do not agree to the terms of this Agreement, you must promptly destroy all copies of the Game.
LEGO reserves the right to modify and update this EULA at any time and LEGO will give you notice of any changes via e-mail and/or by posting the amended EULA on the relevant site. Such amendments and updates shall be effective upon your first use of the Game after LEGO notifies you and makes them available for your review.
The Game is distributed by LEGO and/or its authorized distributors on DVD-ROM and/or through the LEGO.com website or through LEGO approved digital download distributors. The Game may only be played by obtaining access from LEGO to the Game, which is also subject to a separate Terms of Service greement (the "Terms of Service") and Privacy policy. If you have obtained the Game from any other source, it may be defective or significantly revised from the original product. Use of any modified version may be unlawful and is at your own risk.
I. GRANT OF LICENSE:
LEGO hereby grants you (the “User”) a non-exclusive, limited license to use the Game and Manual for non-commercial purposes subject to the following terms:
You may only use the Game as follows:
(a) use the Game on one single computer;
(b ) use the Game on a second computer so long as the first and second computers are not used simultaneously;
(c ) copy the Game for back-up and archival purposes, provided any copy made must contain all of the original Game's proprietary notices; and
(d) use content created through use of the Game for any non-commercial purpose.
You may NOT:
(1) permit other individuals to use the Game except under the terms listed above;
(2) modify, translate, reverse engineer, decompile, disassemble, otherwise reducing the Game to a human-perceivable form (except to the extent that this restriction is expressly prohibited by law), or create derivative works based upon the Game or the Manual;
(3) copy the Game or the Manual (except for back-up purposes);
(4) resell, rent, lease, assign, distribute, or otherwise transfer rights to the Game or the Manual;
(5) transmit the Game or the Manual on the Internet;
(6) use the back-up copy other than as a replacement for the primary copy;
(7) use the Game or the backup copy for any commercial purpose;
( remove any proprietary notices or labels on the Game or the Manual; or
(9) use the Game for any purpose related to the manufacture, marketing, sale or distribution of plastic building bricks.
Any use or transfer in violation of the above will lead to immediate, automatic termination of your license.
II. GAME:
LEGO shall have the right and permission to deploy or provide patches, updates and modifications to the Game, as needed or as useful to:
(i) enhance the gaming experience by adding new content to the Game, (ii) incorporating new features to the Game, (iii) enhancing content or features already in the Game; (iv) fixing ‘bugs’ that may be altering the Game; (v) determining how you and other players utilize the Game so that the Game can be enhanced for the enjoyment of the Game’s users; (vi) protect you and other players against cheating; and (vii) make the gaming environment safer for you. These patches, updates and modifications to the Game must be installed for the User to continue to play the Game. For these purposes, LEGO may update the Game remotely, including, without limitation, the Game as residing on your machine, with or without your knowledge or consent, and you hereby grant to LEGO your consent to deploy and apply such patches, updates and modifications to the Game.
III. TITLE:
All title, ownership, rights, and intellectual property rights in and to the Game and Manual shall remain with LEGO. All rights not expressly granted to you in this Agreement are reserved to LEGO. The Game is protected by national copyright laws and ternational copyright treaties.
Title, ownership rights and intellectual property rights in and to the content accessed through the Game, including any content contained in the Game media demonstration files, is the property of the applicable content owner and may be protected by applicable copyright or other law. This license gives you no rights to such content.
IV. LIMITED WARRANTY:
THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ANY OTHER APPLICABLE STATUTORY WARRANTIES (TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW). THE USE OF THE GAME, HEREUNDER THE QUALITY AND PERFORMANCE OF THE GAME IS AT YOUR SOLE RISK. SHOULD THE GAME PROVE DEFECTIVE, YOU (AND NOT LEGO OR AN AUTHORISED LEGO DEALER) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.
SOME STATES AND COUNTRIES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY BY STATE OR COUNTRY.
LEGO does not warrant that the functionality provided by the programs based on the Game will meet your requirements or that the operation of said programs will be uninterrupted or error free.
Notwithstanding the above, LEGO, however, warrants the Game to be free from defects in materials and workmanship under normal use for a period of ninety (90) days from the date of delivery to you as evidenced by a copy of your receipt.
V. LIMITATION OF REMEDIES:
The entire liability of LEGO, and your exclusive remedy, shall be:
(a) the replacement of any Game not meeting the "Limited Warranty" of LEGO and which is returned to LEGO or an authorized LEGO dealer with a copy of your receipt, or
(b ) if LEGO or the dealer is unable to deliver a replacement Game which is free of defects in materials or workmanship, you may terminate this Agreement by returning the Game and your money will be refunded.
IN NO EVENT WILL LEGO BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION ANY LOST PROFITS, LOST SAVINGS OR OTHER INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE SUCH GAME EVEN IF LEGO OR AN AUTHORISED LEGO DEALER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.
SOME COUNTRIES OR STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
VI. TERMINATION:
This License and your right to use the Game shall terminate automatically if you fail to comply with the provisions of this greement. No notice shall be required from LEGO to effectuate such termination. Upon termination you shall be obligated to destroy all copies of the Game and Manual.
VII. GOVERNING LAW:
This Agreement will be governed by the laws of the country in which you bought the license.
You acknowledge that the export of the Game is governed by the export control laws of the United States of America and other countries. You may not directly or indirectly, export, re-export, download, or ship the Game in violation of the laws and regulations of the U.S.A. or the laws and regulations of the applicable jurisdiction in which you use or are downloading the Game. If you are downloading the Game, you represent and warrant that you are not located in or under the control of any country which the export laws and regulations of such country or of the U.S.A. prohibit the exportation of the Game to. Finally, if you are a unit of the United States Government, you acknowledge that the Game is provided as “commercial computer Game” under terms of this Agreement, and that use, duplication, or disclosure of any Game or any related Manual shall be subject to 48 C.F.R. 2.101 (OCT 1995), consisting of "commercial computer Game" and "commercial computer Game Manual" as such terms are used in 48 C.F.R. 12.212 (SEPT 1995). Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7204-4 (JUNE 1995), or any successor regulations, a licensee shall be provided the licensed Game pursuant to the terms and conditions herein.
VIII. ENTIRE AGREEMENT:
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN US WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN US RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
Please note that all persons under the age of majority in their jurisdiction are required to have a parent or guardian read and accept this Agreement on their behalf.
This Agreement may not be modified except in writing duly signed by an authorized representative of LEGO and you.
IX. MISCELLANEOUS:
The Game utilizes the Akamai NetSession Interface. The Akamai NetSession Interface is secure client-side networking technology that harnesses the power of your computer to deliver software and media available on the Akamai network, improving the speed, reliability, and efficiency of content downloaded from the Web. Your Akamai NetSession Interface works collectively with other Akamai NetSession Interfaces, along with thousands of Akamai edge servers, and runs as a networking service utilizing a limited amount of your computer's available resources and upload bandwidth. I. CREATING ACCOUNT AND ACCESSING THE GAME
To access the Game, you will be required to establish a LEGO ID on www.LEGO.com which does not entail any additional costs. When creating the LEGO ID, you may be required to accept new terms of use in addition to these Terms of Service. You may have to provide LEGO with certain personal information (which will be used in accordance with the LEGO Privacy Policy).
Before you play the Game for the first time, you need to create a LEGO Universe Account. This can be done in 3 easy steps:
Sign in with your LEGO ID or create one if you do not have one yet
Agree to these Terms of Service and the EULA
Enter the activation code printed on the back of the Manual or on any expansions package related to the Game, to activate those expansions to the Account.
II. USER ACCOUNT, PASSWORD and SECURITY
During the registration process you are asked to provide LEGO with current, complete and accurate information as prompted by the applicable registration form.
The Game is subscription-based and you hereby warrant that all information that you submit is true and accurate (including, without limitation, your billing information, credit card number and expiration date) and you agree to pay all subscription fees you incur plus all applicable taxes. It is your responsibility to update and maintain the Account information.
Failure to comply with the foregoing including, without limitation, payment of subscription fees, or to update the foregoing if your contact information or billing information change shall constitute a breach of these Terms of Service, which may result in the immediate suspension or termination and deletion of the Account.
You may also be asked to choose a password and character name. You may not use a character name that is used by someone else, is vulgar or otherwise offensive, infringes any trademark or other rights, or is used in a way that violates these Terms of Service. You may also not use personal information that can identify who you are when choosing your character name.
You are responsible for maintaining the confidentiality of your Account information, including your character name, password and billing information. Please note that LEGO will never ask you to reveal your password to any LEGO employees.
You are responsible for any and all activities that occur under your Account. You agree to notify LEGO immediately of any unauthorized use or theft of your Account or any other breach of security. Your Account is personal to you and you may not transfer or make your Account available to others. Any distribution by you of your Account or related information shall constitute a breach of these Terms of Service, which may result in the immediate termination and deletion of the Account.
III. SUBSCRIPTION PLANS AND PAYMENT
LEGO offers various subscription plans (the "Plan(s)") for playing the Game. If you purchase a subscription to the Game, in exchange for access to the subscription version of the Game, you hereby authorize LEGO to charge your credit card, debit card, PayPal account or other payment method accepted by LEGO (the "Payment Method"), in an amount equal to the subscription fees (plus any applicable taxes we are required to collect) associated with the Plan you have chosen. You can find information regarding the Plans offered by LEGO, including the duration, costs and billing procedures of such Plans, by visiting www.LEGOuniverse.com/parents/subcription
These Plan procedures and information, as updated from time to time, are incorporated into these Terms of Service by this reference.
LEGO will bill your Payment Method the subscription fee of the Plan you have chosen (plus any applicable taxes we are required to collect) on the day you subscribe to the Game or within a reasonable time thereafter, and will charge your Payment Method on a recurring basis pursuant to the terms of the Plan you have chosen, unless you timely cancel your membership before the next billing period.
The subscription fee is due and payable in U.S. dollars, Euros, or some other currencies depending on country of residence as stated in your LEGO ID account, subject to any exchange rate that a credit card company or other financial institution may apply.
Please note that charges to your Payment Method will show in your statements as LEGOuniverse.com If there is any change in the information concerning your Payment Method (e.g. if you wish to use a different credit card or if your credit card has a new expiration date), you must notify LEGO by updating your information in your Account or by contacting customer service at www.LEGOuniverse.com/help. If a charge to your Payment Method is denied for any reason, LEGO shall have the right to suspend or terminate your subscription and your access to the Game and/or terminate your Account.
Your subscription will continue and renew automatically unless cancelled or terminated in accordance with these Terms of Service. On or about the renewal date for your subscription, we will charge your Payment Method at the then current renewal rate (plus any applicable taxes that we are required to collect), and you authorize us to do so. You may cancel your subscription to a Plan at any time by updating your information in your Account or by contacting customer service at www.LEGOuniverse.com/help. Your cancellation must be communicated to LEGO at least 2 working days before the next billing and will be effective at the end of the billing period during which you notify LEGO of your cancellation, and you will continue to have access to the Game until the conclusion of such billing period. All fees paid are non-refundable. You agree and acknowledge that you are not entitled to any refund for any amounts which were pre-paid on behalf of the Account prior to any termination.
If you have a balance due on your Account and you have provided LEGO with a credit card, you agree that LEGO can charge these unpaid fees to your credit card or debit them from your debit card as applicable. You agree to reimburse LEGO for all costs and expenses incurred by LEGO in collecting payment due hereunder, including without limitation all bank or service charges, and any reasonable attorney’s fees.
LEGO may change its fees and external billing methods which could directly impact you at any time effective immediately after notice of these changes are given: at the time you access your Account through game launcher or patcher, or at www.LEGOuniverse.com. You are responsible for reviewing the billing section of such web site to obtain timely notice of such changes.
You are solely responsible for (a) providing your own internet access; (b ) any telecommunication charges or other charges which you incur through access and use of the Game, including without limitation any premium charges and surcharges due to bandwidth consumption; and any taxes payable by you in connection with such access and use.
IV. USER GENERATED CONTENT
You are able to freely create models with LEGO elements collected within the Game and place them on your property within the Game.
You acknowledge and agree that all content, including without limitation all designs, models, characters created and virtual items, acquired and developed as a result of Game play, are the sole and exclusive property of LEGO and may be used by LEGO for any purpose, without monetary compensation or credit to the provider of the content. You also give up any claim that any use by LEGO of any content violates any of your rights, including but not limited to moral rights, rights to publicity, proprietary rights or other rights, or right to credit for the material or ideas set forth therein.
If and to the extent you are deemed to have retained under applicable law any right, title or interest in or to any portion of the content, you hereby transfer, grant, convey, assign or relinquish solely and exclusively to LEGO all of your right, title and interest in and to the content, without reservation and without additional consideration, under applicable law in perpetuity and in the alternative, to the extent such assignment is ineffective under applicable law, you hereby grant to LEGO the sole and exclusive, irrevocable, sublicensable, transferable, worldwide, paid-up license to reproduce, fix, adapt, modify, translate, reformat, create derivative works from, manufacture, introduce into circulation, publish, sell, license, sublicense, transfer, rent, lease, transmit, publicly display, publicly perform, provide access to electronically, broadcast, communicate to the public by telecommunications, display, enter into computer memory and use and practice the content all modified and derivative works hereaf, all portions and copies thereof in any form, all inventions, designs, and marks embodied therein, and all patent, copyright, trade secret, trademark and other intellectual property rights thereto, or to incorporate the same in other works in any form, or technology now known or later developed.
V. RULES OF CONDUCT
These Rules of Conduct are designed to protect you when playing the Game.
You agree not to do any of the following while accessing or using the Game:
(i) transmit or facilitate the transmission of any User Generated Content that is unlawful, harmful, threatening, abusive, harassing, bullying, tortuous, defamatory, vulgar, obscene, libelous, that may be invasive of another's right of privacy or publicity, hateful, racist, *Violation*68*, political, religious, harmful for the LEGO brand or otherwise objectionable;
(ii) impersonate any person or entity, including but not limited to, a LEGO employee, moderator, representative or agent (or an official, employee, representative or agent of LEGO affiliates, licensors or licensees), message board leader, guide or host or falsely state or otherwise misrepresent your affiliation with a person or entity;
(iii) transmit or facilitate the transmission of any User Generated Content that you do not have a right to transmit, under any law or under contractual or fiduciary relationships (such as nondisclosure agreements);
(iv) transmit or facilitate the transmission of any User Generated Content that contains a virus, corrupted data, Trojan horse, bot, keystroke logger, worm, time bomb, cancelbot or other computer programming routines that are intended to and/or actually damage, detrimentally interfere with, surreptitiously intercept or mine, scrape or expropriate any system, data or personal information;
(v) delete any author attributions, legal notices or proprietary designations or labels that are related to the Game
(vi) use the chat system in a manner that adversely affects the availability of its resources to other users (e.g., excessive shouting (use of all caps), flooding (continuous posting of repetitive text);
(vii) transmit or facilitate the transmission of any unsolicited advertising, promotional materials, "junk mail", "spam", "chain letters", "pyramid schemes" or any other form of solicitation or campaigning;
(viii) intentionally or unintentionally violate any applicable local, state, national or international law, rule or regulation;
(ix) transmit or facilitate the transmission of any User Generated Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
(x) transmit any User Generated Content which discloses your or any other person's identity or personal information; and
(xi) transmit or facilitate the transmission of any content to an e-mail address, messenger-feature address or other location that is not yours or to which you do not have the expressly authorized right to use without securing the prior authorization of such other person or entity.
LEGO retains the right to suspend, terminate, or otherwise sanction your Account and/or Game subscription if you violate these Rules of Conduct, as well as to take any other action required or permitted under any applicable laws.
You can report violations of these Rules of Conduct within the Game at any time. The LEGO moderation team will then deal with your report.
VI. CHILDREN SAFETY POLICY
The Game is a moderated gaming environment meaning that the Game is monitored at all times for safety purposes. A team of LEGO moderators will lead this effort.
Any infringements of these Terms of Service will lead to moderation actions, e.g warnings, mutings and suspensions (temporarily or permanent ban) from the Game.
LEGO uses both advanced technology and professional moderators to protect children during the Game. Our technology includes filtering systems that automatically block inappropriate content. LEGO also employs various cutting-edge software solutions that detect inappropriate content and behavior and alert our moderation team. Finally, LEGO has real people with moderation expertise looking over all submissions before they gareet published.
You can report violations of inappropriate behavior within the Game at any time. The LEGO moderation team will then deal with your report.
Please note:
(i) You will not receive compensation for any play time lost due to suspensions (bans), kicks, mutes or any other moderation action the Game moderators see fit to use on your Account. All moderation actions are taken against the Account. Therefore any suspensions, warnings, mutes, or other moderation actions taken against a particular character on an Account will impact all characters on the Account.
(ii) All LEGO models and properties containing models are checked by human moderators for violation of LEGO policies.
(iii) Players who are Best Friends will be able to share models and properties before they are moderated.
(iv) All visible text written in the Game will be pre-moderated and monitored, including mails, names of characters, pets, models, properties, descriptions, and chat.
(v) All chat will be based on a LEGO controlled dictionary. The chat system will only allow words that LEGO moderation has deemed safe. Moderation reserves the rights to terminate your Account if your behavior is deemed in conflict with the Game policies on safety and abuse.
(vi) You acknowledge that any and all character and account data that is stored and is resident on LEGO servers, and any and all communications that you make within the Game (including, but not limited to, messages solely directed at another player or group of players) traverse through our servers, may or may not be monitored by LEGO or LEGO agents (where and to the extent permitted by applicable law), you can have no expectation of privacy in any such communications, you expressly consent to such monitoring of communications you send and receive, and you expressly agree to waive any rights of confidentiality that you may have in and to such communications.
If you breach these Rules of Conduct, it may result in the immediate termination and deletion of your Account.
A permanent ban will lead to a suspension or complete termination of your Account; this could be because of, but not limited to, serious breaches of the Terms of Service such as extreme hate speech, *Violation*68* predation, persistent bullying and trouble-making.
A temporary ban will lead to a suspension of your Account pending investigation into your behavior. This could be for, but not limited to, reported bullying, hacking, griefing and gold farming. In such circumstances your subscription will continue without you being able to play. Investigations will be completed in a reasonable time. Once any investigation is complete, LEGO reserves the right to reinstated or permanently ban your account.
VII. DATA PROTECTION
All data submitted or captured about you will be stored on servers owned and/or controlled by LEGO.
Data may be transferred to or from all countries of the world as necessary for operation of the Game, including countries which provide for a different level of data protection safeguards than your country. All such transfers will take place under the control or by agreement with LEGO.
By clicking the “I accept the Terms of Service” button below you hereby consent to transfers of data as set out herein.
VIII. TITLE, COPYRIGHT AND OTHER INTELLECTUAL PROPERTY RIGHTS
All title, ownership, rights, and intellectual property rights in and to the Game and Manual shall remain with LEGO. All rights not expressly granted to you in this Agreement are reserved to LEGO. The Game is protected by national copyright laws and international copyright treaties.
You may not copy or download any content from the Game unless you are expressly authorized to do so.
You agree not to remove, obscure, or alter copyright, patent, trademark, or other proprietary rights notices affixed to content. You may not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of content. LEGO reserves all rights in owned and licensed content that are not expressly granted to you in these Terms of Service.
Making unauthorized copies of content found in the Game may result in the suspension or termination of your Account, prohibition to use this software and further legal action.
IX. LIMITED WARRANTY:
THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ANY OTHER APPLICABLE STATUTORY WARRANTIES (TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW). THE USE OF THE GAME, HEREUNDER´THE QUALITY AND PERFORMANCE OF THE GAME IS AT YOUR SOLE RISK. SHOULD THE GAME PROVE DEFECTIVE, YOU (AND NOT LEGO OR AN AUTHORISED LEGO DEALER) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.
SOME STATES AND COUNTRIES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY BY STATE OR COUNTRY.
LEGO does not warrant that the functionality provided by the programs based on the Game will meet your requirements or that the operation of said programs will be uninterrupted or error free.
Notwithstanding the above, LEGO, however, warrants the Game to be free from defects in materials and workmanship under normal use for a period of ninety (90) days from the date of delivery to you as evidenced by a copy of your receipt.
X. LIMITATION OF REMEDIES:
The entire liability of LEGO, and your exclusive remedy, shall be:
(a) the replacement of any Game not meeting the "Limited Warranty" of LEGO and which is returned to LEGO or an authorized LEGO dealer with a copy of your receipt, or
(b ) if LEGO or the dealer is unable to deliver a replacement Game which is free of defects in materials or workmanship, you may terminate these Terms of Service by returning the program and your money will be refunded.
IN NO EVENT WILL LEGO BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION ANY LOST PROFITS, LOST SAVINGS OR OTHER INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE SUCH GAME EVEN IF LEGO OR AN AUTHORISED LEGO DEALER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.
SOME COUNTRIES OR STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
XI. TERMINATION:
These Terms of Service and your right to use the Game shall terminate automatically if you fail to comply with the provisions of these Terms of Service. No notice shall be required from LEGO to effectuate such termination. Upon termination you shall destroy all copies of the Game and Manual.
XII. GOVERNING LAW:
These Terms of Service ill be governed by the laws of the country n which you bought the Game.
You acknowledge that the export of the Game is governed by the export control laws of the United States of America and other countries. You may not directly or indirectly, export, re-export, download, or ship the Game in violation of the laws and regulations of the U.S.A. or the laws and regulations of the applicable jurisdiction in which you use or are downloading the Game. If you are downloading the Game, you represent and warrant that you are not located in or under the control of any country which the export laws and regulations of such country or of the U.S.A. prohibit the exportation of the Game to. Finally, if you are a unit of the United States Government, you acknowledge that the Game is provided as “commercial computer Game” under terms of this Agreement, and that use, duplication, or disclosure of any Game or any related Manual shall be subject to 48 C.F.R. 2.101 (OCT 1995), consisting of "commercial computer Game" and "commercial computer Game Manual" as such terms are used in 48 C.F.R. 12.212 (SEPT 1995). Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7204-4 (JUNE 1995), or any successor regulations, a licensee shall be provided the licensed Game pursuant to the terms and conditions herein.
XIII. PARENTAL CONTROL
Please note that all persons under the age of majority in their jurisdiction are required to have a parent or guardian read and accept these Terms of Service, the End User License Agreement and our Privacy Policy on their behalf.
Parents are encouraged to spend time online with their children under the age of majority and to become familiar with the types of content available in the Game and on the Internet in general. We encourage parents to regularly oversee their kids' use of e-mail and other online communications and in-game player creations. Control tools are available in the Game such as setting play time parameters and limit access to the Game, in addition to the online services and software manufacturers that can help provide a safe online environment for kids. LEGO provides the following services in relation to the Game:
a. Managed accounts: Parent’s and child’s LEGO ID’s have to be linked together in order to activate parental controls. This linking happens through the child’s account.
b.Identity Validation: Parents and players over the age of majority that want to link accounts with children must validate their ID.
c. Best Friends: Parents must approve Best Friend requests that children make in the Game. Once a Best Friends request has been accepted the newly linked Best Friends can build together before moderation on the created content takes place.
d. Play time schedule: Parents utilizing the Play time schedule can control their child’s in-game play time.
Using the parental control tools does not require an Account but only a LEGO ID. To use the parental controls, the child (the Account holder) has to initiate a request for account management to the parent’s LEGO ID. Once initiated, the parent has to validate his/her identity – after that the Accounts are linked and the parent is free to use the parental controls for the child.
In case you establish an Account for your child, you understand and accept that it is your responsibility as the legal guardian to determine whether the Game is appropriate for your child. You may not share the Account with anyone, except that if you are a parent or guardian, you may permit one (1) minor child to use the Account when not in use by you. You are liable for all uses of the Account that has been enabled by you. Notwithstanding anything to the contrary herein, you acknowledge and agree that you shall have no ownership or other property interest in the Account.
XIV. CUSTOMER SERVICE AND IN-GAME SUPPORT
The Game offers numerous ways to get assistance, both from inside the Game and from the official website (www.LEGOuniverse.com/Help).
The LEGO Universe website has answers and solutions to the most common Game questions and technical problems. A knowledge base with the most frequently asked questions and the answers is available, as well as the option to contact LEGO Universe Consumer Service by email or through live chat at specified times. Please visit http://www.LEGOuniverse.com/Help.
If you encounter any issues while playing the Game, several help options are available. You can access the help menu by clicking on the question mark in-game. You then have the most common in-game questions and answers available, you can report a problem and track its progress, and you can contact Consumer Service via mail and in-game chat every day, year-round. You also can find automated fixes for common issues via the help menu, such as the ability to self-smash if you get stuck or lost.
XV. INTERRUPTION OF SERVICE
LEGO reserves the right to interrupt the Game from time to time on a regularly scheduled basis or otherwise with or without prior notice in order to perform maintenance. You agree that LEGO will not be liable for any interruption of the Game, delay or failure to perform resulting from any causes whatsoever.
You acknowledge that the Game may be interrupted for reasons beyond the control of LEGO, and LEGO cannot guarantee that you will be able to access the Game or your Account whenever you may wish to do so. LEGO shall not be liable for any interruption of the Game, delay or failure to perform resulting from any causes whatsoever.
LEGO has the right at any time with or without reason to change and/or eliminate any aspect(s) of the Game as it sees fit in its sole discretion.
XVI. ENTIRE AGREEMENT:
YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM AND AGREE TO BE BOUND BY THEIR TERMS AND CONDITIONS.YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN US WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN US RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.

These Terms of Service may not be modified except in writing duly signed by an authorized representative of LEGO and you.
XVII. MISCELLANEOUS:
Please note that the Game is an online game and requires internet access. In the event of internet failure, some Game data could be lost. LEGO will try its best to resume the lost data, Game stats, Game scores and User Generated Content. LEGO can, however, not be held liable for such internet failures.
A very small percentage of internet users may experience seizures when exposed to certain light patterns or flashing lights. Exposure to certain patterns or backgrounds on a video monitor, or while playing online or video games or while watching a replay or a recording of video game footage may induce an epileptic seizure. These conditions may induce previously undetected epileptic symptoms even in persons who have no history of prior seizures or epilepsy.
If you, or anyone in your family, have an epileptic condition, consult your physician prior to playing. If you experience any of the following symptoms while playing an online or video game -- dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, any involuntary movement, or convulsions -- IMMEDIATELY discontinue use and consult your physician before resuming play.
